Civil Law

The Civil Code, Decree-Law No. 67 of 1980, governs contract, tort and property, and supplies the rules that apply wherever a specialised statute is silent. Procedure is governed by the Civil and Commercial Procedure Law, Decree-Law No. 38 of 1980. Most commercial disputes in Kuwait are ultimately decided on these two instruments, whatever the sector they arose in.

On the contractual side we advise on formation, validity and interpretation, on defects in consent, on performance and its suspension, and on the consequences of breach, including specific performance, rescission, agreed and judicially assessed damages, and the treatment of force majeure and of a change in circumstances. In tort we act in claims for personal injury, damage to property, professional negligence, and liability for the acts of employees and for things in a person's keeping.

We conduct civil litigation at every level of the Kuwaiti courts, and advise on the matters that decide cases before the merits are reached: limitation, capacity and standing, precautionary attachment, reference to the Experts Department at the Ministry of Justice and how an expert's report is answered, and the enforcement of judgments against assets in Kuwait.
