Public procurement is governed by the Public Tenders Law, Law No. 49 of 2016, as amended by Law No. 74 of 2019 and Law No. 1 of 2024, together with its Executive Regulations. Partnership projects are governed by the Public Private Partnership Law, Law No. 116 of 2014. The firm advises local and international companies at every stage of a tender, and the earlier we are instructed the more can be done.
Before submission we advise on registration and classification with the Central Agency for Public Tenders, review the tender documents and specifications for the conditions that carry real risk, and advise on eligibility, local content, consortium and joint venture arrangements, bid bonds and performance guarantees, and the formalities on which an otherwise strong bid is most often disqualified. After the award decision we act on grievances before the competent committees, applications for review of the process, and challenges to the outcome.
During performance, disputes arise over variation orders, extension of time, delay damages, price adjustment, suspension, termination for convenience and the final account. The outcome usually turns on whether the contractor gave notice in the form and within the period the contract required. We advise on the recording and notification of claims as they arise, on the preparation of the claim itself, and we represent clients in negotiation with the contracting authority, before the Experts Department and in proceedings before the Administrative Court.
